Privacy Policy

How we handle personal information on talicms.com — and why this policy does not cover the association websites we build.

Draft — not yet in effect

This policy is a complete draft awaiting legal review, and still has unresolved details marked in orange below. It is not yet in effect. For any privacy question in the meantime, contact us through the enquiry form.

Effective date: [DATE]

1. Introduction

Dazlab Digital Pty Ltd ("Dazlab", "we", "our", or "us") operates TaliCMS, a website platform built for real estate associations.

This Privacy Policy explains how we collect, use, disclose and protect personal information through our website at https://talicms.com and the enquiries you send us through it.

We handle personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Additional rights may apply if you are in the United States (Section 10), or in the European Economic Area or United Kingdom (Section 11).

2. What this policy does and does not cover

This is important, because TaliCMS is used in two very different ways.

This policy covers the talicms.com website: visitors, enquiries, and our marketing activity.

This policy does not cover the association websites we build and operate. When an association uses TaliCMS to run its own website, that association decides what information is collected from its members and the public, and for what purpose. In that relationship the association is the controller of that information and Dazlab acts as its service provider, under the agreement between us.

If you are a member of a REALTOR® association and have a question about how your information is handled on that association's website, contact the association directly — they control that information, and their own privacy notice applies. We can only act on their instructions.

3. Information we collect

3.1 Information you give us

  • Enquiry and demo request forms. Your name, email address, association or organisation name, phone number where you provide one, and whatever you write in your message.
  • Downloads. If you download a resource such as our RFP template, we collect your email address and any details the form asks for.
  • Correspondence. If you email or call us, we keep a record of that exchange.

We also record which page a form was submitted from and any campaign parameters in the link you arrived by, so we know which of our content is useful.

3.2 Information collected automatically

Subject to your cookie choices (Section 5):

  • PostHog — product analytics. Pages viewed, links clicked, approximate location, browser and device type. We use it to understand which content helps and which doesn't.
  • Google Analytics — aggregate traffic statistics.
  • Meta Pixel — measures whether our marketing reaches the right audience.
  • Vercel — our hosting provider, which records standard server logs including IP address, browser type and access times, as a normal part of serving and securing the site.

3.3 What we don't collect here

Through talicms.com we do not collect payment or financial details, government identifiers, health information, or sensitive information as defined under the Privacy Act.

4. How we use it

  • To answer your enquiry and, if you're evaluating the platform, to have a useful conversation about your association's requirements
  • To send you a resource you asked for
  • To send occasional updates, if you've opted in — with an unsubscribe link every time
  • To understand how our website is used and improve it
  • To keep the site secure and working
  • To meet our legal obligations

We do not sell your personal information, and we do not share it for cross-context behavioural advertising as those terms are used under US state privacy laws.

5. Cookies and your choices

We use cookies and similar technologies. A cookie is a small file placed on your device when you visit a site.

  • Essential cookies keep the site working. These can't be switched off.
  • Analytics and marketing cookies — PostHog, Google Analytics and Meta Pixel — are off until you accept them. Our analytics and advertising tags default to denied and are only enabled once you consent.

You can change your choice at any time using Cookie settings in the site footer, and you can manage cookies through your browser.

6. Who we share it with

We don't sell, rent or trade your personal information. We share it only as needed:

  • Service providers who process data on our behalf — Vercel (hosting), Neon (database), PostHog (analytics), Google (analytics), Meta (advertising measurement), Resend (email delivery). They are contractually required to protect it.
  • Professional advisors — legal and accounting, where necessary.
  • Legal requirements — where we're required to disclose by law, regulation or legal process.

7. Where your information is held

Dazlab is an Australian company. Our website infrastructure and databases are hosted in the United States, and our service providers operate in the United States, the European Union and Australia.

Your information may therefore be transferred to and processed in countries other than the one you're in. We take reasonable steps to ensure it remains protected in accordance with applicable law.

8. How long we keep it

  • Enquiries — for as long as needed to respond, and for a reasonable period afterwards for our records
  • Mailing list — until you unsubscribe or ask us to remove you
  • Analytics — according to the default retention periods of the providers named above, typically 14–26 months

9. Security

We take reasonable steps to protect personal information from misuse, loss and unauthorised access. The site is served over HTTPS and we use reputable providers with appropriate security measures.

No method of transmission or storage is completely secure, and we can't guarantee absolute security.

10. If you are in the United States

Most of our visitors and clients are in the US. Depending on your state — including under the California Consumer Privacy Act as amended, and comparable laws in Texas, Virginia, Colorado and elsewhere — you may have the right to:

  • Know what personal information we've collected about you and why
  • Request a copy of it
  • Request that we correct or delete it
  • Not be discriminated against for exercising these rights

We do not sell personal information and we do not share it for cross-context behavioural advertising, so there is nothing to opt out of in that respect. You can still switch off analytics and marketing cookies at any time (Section 5).

To make a request, contact us using Section 13. We'll verify your identity before acting on it.

Again: if your request concerns information held on an association's own website, that association is the controller and you should contact them directly.

11. If you are in the EEA or UK

  • Legal bases. We process your data on the basis of consent (analytics cookies, mailing list), our legitimate interests (responding to enquiries, securing and improving the site), and legal obligations.
  • Transfers. Your data may be transferred to Australia and the United States with appropriate safeguards in place.
  • Additional rights. You may have rights to data portability, to restrict processing, to object to processing, and to complain to your local data protection authority.

12. Other points

Third-party links. Our site links to other websites, including the associations we work with. We aren't responsible for their privacy practices.

Children. Our website and services aren't directed at anyone under 18, and we don't knowingly collect information from children.

Changes. We may update this policy. When we make material changes we'll update the effective date above.
