1. About these terms

These Terms of Use govern your use of https://talicms.com (the "Site"), operated by Dazlab Digital Pty Ltd ("Dazlab", "we", "our", "us"), an Australian company.

By using the Site you accept these terms. If you don't accept them, please don't use the Site.

2. What these terms cover — and what they don't

These terms cover this website: browsing it, reading our content, submitting an enquiry, downloading a resource.

They do not cover the TaliCMS platform itself. If your association has engaged us to build or operate a website, that relationship is governed by the written agreement between your association and Dazlab, which takes precedence over these terms in the event of any inconsistency.

They also do not cover the association websites we build. Each association is responsible for its own site, its content, and its terms.

3. Using the Site

You may use the Site for lawful purposes — learning about our platform, reading our content, and contacting us.

You agree not to:

  • Use the Site in a way that breaches any applicable law
  • Attempt to gain unauthorised access to the Site, its servers, or any connected system
  • Interfere with the Site's operation or security, or attempt to circumvent any access restriction
  • Use automated systems to scrape or harvest content or contact details in a way that places unreasonable load on the Site or is inconsistent with these terms
  • Reproduce or republish substantial parts of the Site for commercial purposes without our permission
  • Misrepresent your identity or your affiliation with any organisation when contacting us

4. Our content

Unless stated otherwise, the content on this Site — text, design, graphics, logos and software — is owned by Dazlab or used with permission, and is protected by copyright and other intellectual property laws.

You may view, download and print content for your own use, and share it internally within your association, including for the purpose of evaluating our services.

Our downloadable resources are meant to be used. Templates and guides we offer — such as our RFP template — may be adapted and used by your association for your own purposes, including in a vendor selection process that doesn't involve us. No attribution required.

You may not otherwise reproduce, republish or commercially exploit our content without our written permission.

5. Trade marks

"TaliCMS" and "Dazlab" are trade marks of Dazlab Digital Pty Ltd.

REALTOR® is a registered collective membership mark owned by the National Association of REALTORS®. Other product and organisation names on this Site, including those of the associations we work with and of other software vendors, are the property of their respective owners. Their use here is for identification only and does not imply any endorsement or affiliation, except where we describe an existing client relationship.

6. Information on this Site

We take care to make the information on this Site accurate and current, particularly where we describe what our platform does and what we've built for our clients.

Even so, the Site is provided for general information. It doesn't constitute a quote, an offer, or a commitment to deliver any particular capability, timeline or outcome. Specifications, features and availability may change.

Comparisons with other vendors reflect our understanding at the time of writing, based on publicly available information. Other vendors' products change. If you're evaluating them, verify the current position with them directly — and if you believe something we've written about your product is wrong, tell us and we'll correct it.

Case studies and figures describe specific projects. Your association's requirements, systems and timeline will differ, and results will differ accordingly.

The Site links to third-party websites, including our clients' websites and other vendors'. We don't control them and aren't responsible for their content, availability or practices. A link is not an endorsement.

8. Enquiries and submissions

When you submit an enquiry or download a resource, you agree the information you give us is accurate, and that we may use it to respond and to communicate with you as described in our Privacy Policy.

Don't send us confidential information through the Site's forms. If you need to share something sensitive about your association's systems, tell us and we'll arrange an appropriate way to do it.

9. Availability

We aim to keep the Site available but we don't guarantee uninterrupted access. We may change, suspend or withdraw any part of it at any time without notice.

10. Liability

To the maximum extent permitted by law:

  • The Site and its content are provided "as is", without warranties of any kind, express or implied
  • We are not liable for any loss or damage arising from your use of, or inability to use, the Site, or from reliance on its content
  • We are not liable for indirect, incidental or consequential loss, including loss of profits or business opportunity

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability can be limited but not excluded, it is limited to re-supplying the relevant content or paying the cost of having it re-supplied.

Our handling of personal information is described in our Privacy Policy, which forms part of these terms.

12. Changes

We may update these terms from time to time. The current version is always the one on this page, and material changes will be reflected in the effective date above. Continuing to use the Site after a change means you accept the updated terms.

13. Governing law
